Acquis Communautaire

Treaties, directives, regulations, case law, recommendations, standards and codified practice which form the European Union Legislation.

ASSESS

Step of the process which compares existing and proposed legislation to identify provisions to be repealed or recodified.

ASSESS Report

Report that certifies that the impact of the Directive on existing national legislation has been processed according to the Dirlab assessment protocol.

CaT

Online software used to transpose directives according to the Dirlab process (PLAN, LABEL, TRANSLATE, ASSESS, TRANSPOSE & IMPLEMENT).

Certification marking

Marking which ensures that the protocol appropriate to a particular step has been correctly applied (√).

Certifier

Third party authorised to deliver a certification marking.

Co-ordinator

Member of the Transposition coordination Team (TcT) who registers a new transposition project in CaT, authorises the users responsible for it and fixes its deadline for completion.

Codification

Procedure by which regrouped acts are repealed and replaced by a single act without introducing substantial modification in any of the said acts.

Codified practice

Voluntary schemes which are adopted by private bodies to regulate their relations with their customers or suppliers.

Comment

Annotation by authorized CaT users to exchange information on ways to process a labelled provision.

Consolidation

Regrouping of various extracts ruling a defined matter without changing its validity and without giving a legal value to the regrouping.

Correct transposition

Legislation transposed on time, with full compatibility and effective implementation.

Dashboard

Displays provisions allocated to a transposer, their real time progress through the process and their certification status at each step of the process.

Decisive provision

Legal provision whose transposition, in part or in whole, depends on decision(s) from a responsible authority in a Member State.

Declaration of conformity

Confirmation by the transposer that each provision of the final transposition report prepared for a certification are in conformity with the referred protocol.

Directive

Act specifying a binding objective which the regulated authority must enforce.

DirlaB

Dir (Directive) laB (labelled) is a system designed to speed up and to improve the process of transposition.

Methodological advice published by CaT to translate, assess, transpose and implement main labelled provisions.

IMPLEMENT

Step of the process which certifies the objectives, organises the means, reports the achievements and proposes improvements for effective implementation according to Dirlab Protocol.

Implement Report

Report that certifies the effective implementation of transposed legislation.

Implementation

Instruction, training & hardware that relate to enforcement of general regulation.

Incompatibility

Discrepancy between the provisions of a proposed directive and existing national legislation.

LABEL Report

Report that certifies the conformity of labelled provisions and the authenticity of the Directive according to Dirlab Protocol.

Labeller

Authorised user who allocates a specific label to a particular provision following an existing labelling plan, or in its absence, who creates a name according to a label protocol.

Language consistency

RIDe function which certifies that word conveys the same meaning in all relevant languages.

Lock data

Software function preventing further modification of a provision entered in CaT.

Mutual evaluation Module evaluates public policies

Multi-user database

Central Database collecting data from CaT users and organised in such a way that relevant data may be shared between all authorised users.

Multi-user Licence Sofware

License allowing the users to use to exchange and share data.

National Recodification

Consolidation of part or all of several directive(s) into one or more legal acts.

Password

Confidential code authorizing the different agents to load, modify and/or consult data stored on the base.

PLAN

Step which registers a new transposition project in CaT, defines its transposer and working group, and fixes its deadline.

PLAN Report

Report that certifies the conformity of the projects registered in CaT with the National Transposition Plan according to Dirlab protocol.

Referent

Expert of EuRefer selected and trained to represent stakeholders.

Regulatory impact

Effect of a project of act or of a new act on the existing regulation

RIDe

CaT’s Ratio of Implementation and Development of a source text at a particular STEP according to the relevant protocol.

Stakeholder

Person who represents an official or non-governmental interested party in a Working Group.

T

Tracker

Function enabling registered members to report bugs, or request improvements in CaT.

TRANSLATE

Optional STEP to record a Project’s translation and to effect a language consistency test.

TRANSLATE Report

Report that certifies the consistency of the language used for the Directive with the terminology used in other Member States’ languages according to Dirlab Protocol.

TRANSPOSE Report

Report that certifies that the text transposed is in conformity with the original directive according to Dirlab Protocol.

Transposer

Agent appointed by the transposition authority and authorised by the TcT (Transposition coordination Team) to prepare the transposing source, to transpose and/or to implement it.

Transposer

Agent appointed by the transposition authority to transpose a Directive and/or to implement it.

Transposition

Action undertaken by a Member State to implement an EU Directive.

Transposition co-ordination Team

Transposition co-ordination Team (TcT) appointed by the government to supervise the process of transposition of directives.

Transposition project

Computer-assisted Transposition Project planned by the Transposition Co-ordination Team and prepared by the authorised transposer.

Working Group

Group composed of stakeholders appointed by a national Transposition Authority to participate to a transposition project.
